Sustain broadband and device access beyond grant funds by inserting permanent upgrade clauses in ISP contracts and adopting 'device as service' procurement models at state scale¶

Description¶
The report recommends two sustainability strategies for states. First, states should use IIJA authority to subcontract with ISPs and "insert into those contracts clauses to ensure there is permanent equitable provision of broadband services," so upgrades in affluent communities trigger upgrades in communities that cannot pay. Second, states can leverage their larger contractual authority to negotiate 'device as service' contracts with Original Equipment Manufacturers, making device procurement an operational rather than capital expense, with OEMs retaining ownership and providing hotspots, cybersecurity updates, maintenance, and replacement.
Design Implications¶
Context¶
Requirements¶
- State contractual authority over ISP subcontracts and OEM device contracts
- Legislative action may be required to mandate a state agency negotiate device-as-service contracts
Constraints¶
- The report notes ISPs "might not always be the best, most affordable or sustainable option for some communities" and that devices "will need to be replaced regularly" due to wear and upgrades
Target Learners¶
- K-12 students in underrepresented and rural communities
Target Learning Goals¶
- constant, reliable 24/7 access to devices and broadband for learning
Related Strategies¶
- Make nine 'big plays' across three focus areas — sustaining access infrastructure, upskilling the educator workforce, and upskilling students, families, and caregivers — in state digital equity and BEAD plans
- Pair technology access with targeted investments in infrastructure, staffing, and support, and pilot initiatives with dedicated budgets
